Trade License

To apply for a Trade/Professional License at the Department of Economic Development, Dubai, the following procedures to be completed:

  • Reserve Trade Name through online. Application Fee: Dhs210 (service charge extra).
  • Get initial approval for activity from Department of Economic Development (DED).

Required Documents:
  • Passport Copy of Partners.
  • Jinsiyya copy (Naturalization book) of local partner.
  • NOC for expatriate partner if he is on Employment Visa). Investor/partner visa holder, Visit visa/Tourist Visa holder do not require NOC.
  • Trade Name reservation copy.

Licenses for some categories of business require approval from certain ministries and other authorities: for example

· Prepare LLC Agreement (Memorandum of Association) and get it attested from Notary Public. Approximate fees for Notarization: Dh1000. If the firm is a Civil Company, Local Service Agent Agreement and Partnership Agreement to be attested.If the firm is a Sole Establishment with 100% expatriate ownership, Local Service Agent Agreement to be attested.If the firm is a Sole Establishment with 100% UAE national ownership, no need any Agreement.

· Take Tenancy Contract of the Office/Shop to the Planning Department (DED First floor) and get approval.

· Submit, Initial approval, Trade Name Certificate, One original copy of Notarized agreement, Tenancy Contract Copy, Passport copies of Partners, NOC and Jinsiyya copy of local partner, at DED.

· Payment Voucher will be ready within 2 days and can be printed through DED website.

· Make online payment or pay at any DED branch and receive the License.

· If the License is Commercial, it has to be registered with Dubai Chamber, which is there at the same DED building. Fill the authorized signature form, put seal and signature of partners and submit at Dubai Chamber counter. Certificate will be issued same time. Payment already paid along with the license fees.

· Next procedure is applying for Immigration and Labour Establishment Cards.

Trademark Registration

Trademarks registration and protection is regulated by Act Number 37 of 1992. Trade marks, including names, words, symbols, and pictures, are registered in the Trade Marks Register kept by the Ministry of Economy and Commerce. A trade mark may be registered in the name of its owner. The application for registration of a trade mark is submitted to the Ministry of Economy and Commerce by the owner or by his appointed attorney in the UAE. Interested third parties may oppose the registration of the trade mark within 30 days after publication is made in the newspapers and the Official Gazette. Registration of a trade mark will take effect from the date on which the application for registration was submitted. Such registration will provide the trade mark with protection for a period of 10 years, with renewal available for a similar term.

Trade License Renewal

How to renew Trade License in Dubai?

Following documents are required for Trade/Professional License renewal

• Typed form (BR/1)

• Copy of Trade License

• Copy of Tenancy Contract and EJARI Registration Certificate


NOTE: Three options are available for Trade License renewal

Option 1: Take the above mentioned documents to Tas'heel Business Centre at Al Tawar Centre in Al Qusais. Note that there are two Tas'heel Centres in Al Tawar Centre. For license renewal, you should go to the first floor, where Tas'heel Business Centre (Office 18) can be found next to Economic Department. Go to the Reception Hub and pay Dh50 as service charge. When your token number displays, go to the counter and hand over the documents. After scanning your tenancy contract, they will issue payment voucher. You can make payment at the Cashier and get the license same time or pay latter through online by Credit Card or bank account (CBD, ABIB, DB). If you want to add Post Box number or telephone number in the license, Dh40 to be paid extra.

Trade Name reservation, Initial approval for new license and Trade License printing service also available in this centre. License printing charge: Dh20

Option 2: Deposit all the above mentioned documents in the Yellow Box found in front of the Department of Economic Development (next to Bus waiting shelter), Deira main office, near Etisalat. Payment voucher can be printed from DED website after three working days by entering the license number. You can pay online using Credit Card or through Direct Debit bank account (CBD, ABIB, DB).

Option 3: Create a new user account in DED Website for your company. After submitting required information, you will get username and password. Print the authorization form which is found bottom of the page, fill the information, put seal and signature and submit at the DED Dubai Mall branch or Business Village branch near Clock Tower. Attach Trade License copy, Partners list and your passport copy. You should be a partner/manager to get authorization. After activation, you can enter DED site and manage your license transactions including renewal. For renewal, you will have to enter necessary information, scan the Tenancy Contract and EJARI Registration Certificate. After three working days payment voucher can be printed from DED website. You can pay at DED branches or online using Credit Card or through Direct Debit bank account (CBD, ABIB, DB).

To renew Contracting/Maintenance related licenses, Municipality approval to be completed through online.

License Cancellation

What are the documents required for Trade License Cancellation in Dubai?

STEPS TO FOLLOW

1. Cancel all existing employees, if any.

2. Type Labour Establishment Card Cancellation form from Tas'heel Center. No government fees there. Only typing charge to be paid.

3. Get seal and authorized signature of the company on the application and submit at any of the Labour Office branch. Labour counter is available inside Economic Department, Deira, Near Etisalat. Labour office will issue their NOC by putting a stamp on the application you submitted.

• You should prepare the above mentioned cancellation form even if your company didn't make a Labour Establishment Card.

4. Then type license cancellation form of Department of Economic Development, get signature of the owner and submit at DED.

• Pay at Department of Economic Development for cancellation

• Economic Department will issue a file number and take it to Department of Protective Systems (DPS) in Al Qusais, (Tel. 04-2048118) to get clearance from Police authority. If there is no any violations in Police records, they will send clearance message soon to DED electronically.

5. Go to Economic Department again and pay to get Cancellation Certificate.

6. Take this certificate to Immigration Head office in Jaffliya along with a request letter in Arabic and original Immigration Establishment Card. If the card is lost, you will have to get Certificate of Loss from Police. To get this certificate, prepare a request letter in Arabic and submit it at your nearest police station and pay . Certificate will be issued after two days.

NOTE: No fees required in Immigration for cancellation. But fine will be charged for each month after expiry of the card.

License Renewal (Contracting)

To renew Contracting/Maintenance related licenses, the following procedures to be completed at Dubai Municipality through online.

• Click here for the list of activities controlled by Dubai Municipality.

• Type License renewal form (BR/1) of Economic Department (DED) and submit at the counter to get Transaction number. DED Main Office: Deira, near Etisalat, opposite to Dubai Chamber.

• Fill online application of Dubai Municipality. The following documents are required:

• Copy of Trade License

• RTA statement stating the details of vehicles. To get vehicle list from RTA, a request letter in Arabic should be prepared in company letterhead with seal and signature. Go to any RTA Customer Care Centre office to get Vehicle List.

• Tenancy contract of office and Labour Camp with EJARI registration Certificate.

• Labour Camp report issued from Ministry of Labour (If camp is outside UAE).

• Employee List printed from Labour website.

• Company comprehensive report from Ministry of Labour (This report can be collected from any branch of the Ministry of Labour).

• Approved Engineer's Passport copy with visa page, attested Educational certificate, one photograph and copy of Society of Engineers membership. If the membership is not issued, a confirmation letter in Arabic stating that your company will arrange the membership for the engineering within three months.

• Engineer's pass certificate from Dubai Municipality or date of pass.

• If the requirements are fulfilled, online application will be approved within 2 working days. Municipality will charge for each Engineer/Technical Staff. This amount can be paid online. Approval will be displayed on DM website and will send the information electronically to Economic Department. Approval print has to be attached with DED application form and proceed for license renewal process.

Following documents are required for Trade License renewal at DED

Media License

Following are the Media activities controlled by UAE Media Council. To practice any of the following activities, the applicant has to get Media License first before applying for Trade license at the Department of Economic Development.

Required Documents for Media License:

Passport copy and Jinsiya (family book) copy of local sponsor, his educational certificate (for certain professions), Filled form (can be collected from Media Council office at Al Qusais, Tel. 04-2615500) and two photos.

New Contracting License

To register a new Contracting License, the following procedures to be completed at Dubai Municipality through online.

• Type initial approval form of Economic Department (DED) and submit at the counter to get Transaction number.

• Fill online application of Dubai Municipality. The following documents are required:

• Copy of Naturalization book/Jinsiyya for UAE nationals.

• Copy of passports (of the licensees + partners + manager) with residence visa page or copy of Visit/Tourist Visa).

• Copy of valid initial approval issued by Dept. of Economic Development (Activity + Partners + Trade Name).

• NOC from the sponsor for expatriate partners.


Note: No need NOC for Visit and Tourist visa holders. Visit visa holder can change status inside country. But Tourist visa holder must exit and enter again to get Investor/Employment visa.


• If the requirements are fulfilled, online application will be approved within 3 working days. Approval will be sent online to the applicant and to Economic Department. This print has to be attached with DED application form and to be submitted at DED counter along with other documents.

Real Estate License

Activity No. 702001
License Type: Commercial

Nature of activity:

Includes firms dealing with buying and selling of property acting as brokers between the owners and buyers. The role ends with the signing of the contract and upon receipt of agreed commission.

Conditions:

• Companies are not allowed to be owner or partner.

• Owner must be at least 21 years old.

• Real Estate Practitioner Course for Bachelor Degree holder and Diploma in Real Estate Course for non-graduate owner/partner (This course is conducted under Real Estate Regulator Authority - RERA).

• Incase of expatriate Manager, his visa must be under this license.

• Certificate of Good Conduct from CID for all owners/partners.

Note:

• After issuing the License, all owners, partners, managers and sales staff must get broker ID Card from RERA.

• Owners are not allowed to have more than one real estate brokerage license.

• Branch office is allowed only if the parent license having minimum 15 staff.

• Activity fee Dh5000 per year, to be paid at RERA. Economic Department fee is separate.

Professional License

To apply for a Trade/Professional License at the Department of Economic Development, Dubai, the following procedures to be completed:

Ejari Tenancy Contracting

What is EJARI?
EJARI means ‘My Rent’ in Arabic. Ejari is a system that is governed by RERA to make registration of rental / lease agreements easy and accessible to Owners and Real Estate Management Companies of various categories. The Ejari system provides a full portfolio of services beyond registering the initial lease agreement. Renewals, cancellations, transfers and terminations can all be logged.

What is Premises number and where can I get it from?
Premises number is a 9 digit identification code provided for each unit of the building. First three digits (community number) represents the first part of your plot number. Premises number is found on the door of each unit fixed by DEWA.

NOTE: EJARI registration cannot be done if the Tenancy Contract is issued from other emirates (eg. Abu Dhabi, Sharjah, Ajman..etc). In that case, the contract has to be attested from concerned Municipality/Land Department and attach Electricity Bill.

Frequently Asked Question

Q: I understand that at the time of renewing a flat, I should pay not more than Dh260 for renewal. The agent at International City asked me for Dh1,000 to Dh1,500 to renew the contract. I stayed for one year and the agent is asking me paint the studio apartment or pay Dh250. I went to the police station whereby I have been told to pay Dh150 for the painting. Is this rule applicable in Dubai?

A: As a general rule, a tenancy contract should be renewed on the same terms and conditions unless the parties to the contract otherwise agree. If the parties do not agree, the increase must be approved by the Rent Committee. A landlord/agent cannot increase the rent or related expenses without obtaining a verdict from the Rent Committee.

Furthermore, on one hand, while the law imposes an obligation upon the landlord to hand over the property in good condition, on the other hand, the law obliges the tenant to take care of the leased property. No person, including the agent or landlord, is allowed to impose a fine or decide the value of damage without obtaining a valid verdict from the Rent Committee. If the condition of the paint is normal and comes under normal wear and tear, it is the landlord’s responsibility. Otherwise, it will be your responsibility.

It is worthy to note here that in case of dispute between you and the landlord regarding its condition, the dispute should be referred to the Rent Committee.
